PS4 Lost data after upgrading to ps5

Just upgraded to ps5 and downloaded the game and my save is not there even tho is says its saved to the cloud?? Like this has happened for the second time to my data! Honestly not starting the game from the start again. Anyone know if there’s a way to get a refund on this game cause I’ve honestly have had enough time waisted at this stage
